SB-268 New Hampshire Senate

February 17, 2026

A bill that allows sex discrimination in some venues including mental health facilities

Passed the Senate in 2025 and the House in January 2026 but was Vetoed by the Governor

NAMI NH recommended opposing this bill and wrote the following in their testimony to the Senate: 'By rolling back the discrimination protections we currently have under state law, SB 268 puts the mental health and safety of New Hampshire individuals and families at risk. With this policy in place, transgender and nonbinary Granite Staters will be exposed to discrimination - in their communities, at work, in treatment, and beyond. This would have a chilling effect on not only transgender and nonbinary people themselves, but also their families, their loved ones, and the communities they have found and formed in our state'.

We will be tracking other similar bills moving through the House in 2026
